Human resource departments are responsible for effectively, legally, fairly, and consistently attempting to maximize an organization’s return on its human capital investment while minimizing financial risk. This is why labor laws and Civil Acts are placed in the work place and other felicities to insure the well fare of others are without risk and effective(WGU). Analysis of Situation A In every situation all bases need to be covered and all information gathered before any request is finalized. It is necessary to establish whether the employee qualified for the leave and whether the terms as stipulated under the Family and Medical Leave Act of 1993 (FMLA) were actually met. The Act requires that for one to benefit from the leave he or she must have worked with the employer for more than 12 months. Employee A had worked for 2 years and it can be deduced that he had successfully completed at least 1250 hours at the work place. The rationale of the law is to make it possible for one to accomplish his professional obligations and personal ones without having to choose one at the expense of another. The reason for the leave must be for the care of a family member who has a serious health condition or one’s own health condition. Employee A asked for the leave to take care of his wife who had prematurely given birth to twins. In fact, this is one of the reasons listed in the FMLA for this type of leave. It is not difficult to discern that this is a serious medical condition which requires continuous care of the patient. Therefore, employee A should not be subjected to any victimization upon his request of leave. Focusing on the duration of the leave, an employee is entitled to up to 12 weeks of this type of leave, so long as the right paperwork is provided. Employee A had been out for 11 weeks, hence, was still within the statutory period of 12 weeks. Since the issue of paper work is not a concern under this situation, I have confidence that he supplied all the required documentation. The employee must be reinstated to the same position he held before the leave, so long as he  still is able to perform the essential function of the job. Employee A was still able to perform the functions of the job. Hence, he was reinstated to his former position. On the issue of pay during the leave, the Act does not require employers to pay the employees during the leave but any arrangement to the contrary must, however, be respected. Since, there was no agreement to this effect with the employer; the manager is under no obligation to pay the withheld salary for the 11 weeks. The new manager in withholding the salary did not breach any law and this decision cannot be properly said to be discriminatory laws, in this case FMLA (Lau & Lisa, 2013). Analysis of Situation B General laws of Human Rights are captured in the U.S. constitution. The Civil Rights are contained in the Civil Rights Act of 1964. The specifics of employment law are contained in various federal statutes that address specific issues in employment law. The employment law to be considered in the current situation is the Age Discrimination in Employment Act of 1967 (ADEA). The brief statement of the facts regarding employee B is that he was 68 years of age and had served Company X for 42 years and was assessed to be above average on his performance. He was allegedly not promoted because of his age with the company preferring a younger employee of 32 years who received a performance review of adequate. First of all, Company X is bound by the Act, since it had 75 employees which is way above the minimum requirement of 20 employees. As such, Company X in hiring, promoting or firing its employees must pay due regard to the requirements of the Act. Secondly, employee B is currently 68 years old, meaning that he is protected by the Act which states that it protects workers above the age of 40. If the assessment of both employees revealed that the older one was still performing better than the younger one then it would be hard to find a genuine reason for the promotion of the younger employee. Additionally, the situation does not fall under the exception of Bona Fide Occupational Qualification (BFOQ) stipulated in the Act. Under this exception, a younger employee can be preferred to an older one if it is objectively established and to some extent obvious that the job cannot be effectively performed by the older employee. In view of the foregoing, I rest upon the conclusion  that there was discrimination on the basis of age in selection of the younger employee for the promotion at the expense of employee B. The fact that the employee was not asked to sign an ADEA waiver or any document to the effect confirms my position. Age was the ‘but for’ reason for lack of promotion of the employee (Lau & Lisa, 2013). Analysis of Situation C The only purpose that Company X gave for failure to hire employee C was that such a move would have been costly to the company. Therefore, I would assume that the employee was qualified for the job as the applicable statue (Americans with Disabilities Act of 1990) applies to qualified but disabled persons. Consequently, it cannot be doubted that employee C was qualified for the job. Secondly, the Act gives considerations of whether the disabled person can perform the essentials of the job. Under this test it would be understandable when a company fails to hire a blind person as a driver. This is impossible since such a person cannot perform the essential functions of the job. Accordingly, the Act also permits the failure to hire a disabled person if it will require reasonable accommodation in order to perform the job. The essential function of the job would be incompatible with employee C’s situation and as such the level of accommodation required was too high. Company X’s decision not to hire employee C does not amount to discrimination but an instance of genuine distinction. The adjustments needed to accommodate employee C would be too much and, therefore, the decision not to hire him is not discriminatory against him. As a result, employees are more protected since they are the fragile parties in the employment contract bargain. This is because employees can be exploited by ill-intentioned employers. As such employment laws together with other human rights laws take care of employees. The laws also protect the interests of employers by lining the duration of certain leaves, qualifications for some benefits as discussed above and hiring of employees on the basis of merit and not any other considerations. Many high school students are eager to report their accomplishments to colleges when it comes time for college applications. For some achievements, this is easier done than others. There are places on the Common Application to report your academics recognitions and awards earned in extracurriculars. Not all achievements can be so easily reported, though. Reporting official test scores is a little more involved. Official score reports for tests like the SAT, the ACT, and even AP exams must be sent directly from the testing agency. In the case of the AP exams, this means that in order to have an official score report sent, you will need to request one from the College Board. In this post, we’ll outline the three ways in which you can have an official AP score report sent, and how to self-report your AP scores as well. The simplest and most efficient way of requesting a score report sent to your college of choice is by selecting this option on the AP answer sheet at the time of your AP exam. This is not only the easiest way to report scores, but also the cheapest way. When you take the test, you are given one free score report, but only if you request it on your answer sheet. Simply fill in the four-digit code for the school of your choice and your official score report will be sent to that college. Keep in mind that your score report is cumulative. This means that the college will receive not only the score for your most recent exam, but also your scores on any previous exams (unless you have deleted or withheld them, which we’ll discuss later). You should also know that you will have an opportunity to cancel your score report if you receive your score and decide you don’t want it sent, but you will have to pay for this service. You can also send score reports after the fact by logging into your College Board account. Simply visit the College Board login and follow the prompts to select score reports. The evil, created by humans, is outweighed by good in the world of King Lear. Evil was created by humans who decided to do wrong to others. Lear believes that since Edgar is out on the heath he must have given everything to his daughters as well (ACT III, iv, 62ff). Since he believes that Edgar gave everything to evil Lear must believe that people are the cause of evil. It was Lear's daughters who decided to do wrong to Lear and it was Lear's fault in giving away all of his land. His daughters are the humans in the play, it is the humans who caused the evil and Lear believes that humans were the ones who created evil. Edgar, is another character in the play who believes that evil is caused by humans and not the gods. Edgar said, "The gods are just, and of our peasant vices make instruments to plague us" (ACT V, iii, 169). Edgar clearly says that the gods are right and it is t he people who are responsible for promoting evil in the world. It is us who make the instruments necessary for evil to spread and plague the world. In the world of King Lear many characters believe evil was caused by the people and not by the gods. Even though Humans created evil, good will always exist. After King Lear was captured he showed that even if evil exists, good will always be present. Lear speaks about love with Cordelia in the prison cell and how they will still have each other despite of the evil around them (ACT V, iii, 8). On another occasion Lear also says that despite all the evil in the world the raw nature, which is good, is still unharmed (ACT IV, IV, 90-92).

Minoan Crete was a civilization experiencing great social and economic prosperity during its zenith around the time known as Late Minoan 1 (LM 1) (Sheppard Baird 2009). However the Minoan population ended abruptly and seemingly simultaneously 430 years later, this left archaeologists and historians searching for the cause (Castleden 1990, 143). The main reason archaeologists are studying the reason for the downfall is because if a date was known, a more precise historical timescale could be produced that would give a more accurate chronology of ancient history during this time (Barber 1990, 221). Ever since Sir Arthur Evans developed the concept of the Minoan civilisation, there have been many proposed reasons for the downfall, each with their own evidence and supporters (Sheppard Baird 2009). It was in 1939 that Syridon Marinatos, a leading 20th century archaeologist of Crete, initially suggested that the volcano Thera was the reason for the Minoans demise (Castleden 1990, 143). Ma ny more hypotheses as to what caused the destruction have stemmed from this initial thought, such as tsunamis, economic and agricultural decline as well as foreign invasion. However due to advances in science and further studies into Thera and the Minoan’s history, this volcano no longer seemed the only plausible cause for the disappearance of Minoan Civilisation (Sheppard Baird 2009). Thera was located on the present day island of Santorini, 120 km north of Crete, and for hundreds of years there was little to no activity. Background Information Meiosis is the process by which eukaryotic organisms produce egg and sperm having half the genetic information (haploid) of the other cells in the organism’s body (diploid). You will notice some similarities to mitosis but some definite differences in meiosis that result in genetic diversity in the gametes as well as the offspring formed by the eventual fusion of the egg and sperm. Two of the most noted differences in meiosis are that 1) there are two complete divisions resulting in four daughter cells and, 2) meiosis has crossing over, an even that occurs in Prophase I that increases genetic variation in the gametes. Crossing over occurs between homologous chromosomes. These are the pairs of chromosomes in an organisms body that carry genes for the same trait located at identical positions on the two chromosomes. Even though they carry the same gene they may, however, possess different alleles for the gene which result in different forms of the trait. Pre-Lab: 1. I did not know that 6 months prior to my attempt to buy the property at 3496 Main Street, the Supreme Court had upheld Keel vs†¦ New London. This law allows a city to use eminent domain to redistribute personally owned real estate to develop additional tax revenue. The city of Lemon Grove intentionally denied me any permit to operate a business in Lemon Grove.The repose behind their decision was to force default on the commercial property that I had purchased. My liquor license and business equipment have yearly and storage fees. Devastating! Attraction's hired me and my life stabilized. My thoughts were about the way that I was treated by some selfish connected people. This made me really mad. That did not matter, they endorsed Todd Gloria. I received a standing ovation at Earth Day in Balboa Park for advocating the legalization of marijuana for recreational purposes. This reaction caused Todd Gloria to restate his position from zero tolerance to allowing medical marijuana legalization. Our major campaign issue was the San Diego Wastewater Treatment Plant in Point Loam. This wastewater treatment plant is not currently up to code in the National Pollution Disch arge Permitting Elimination System.In 2008, most people did not see the coming secession and were making money by overdeveloping every market and resource in San Diego. My campaign staff was working for ideas back then that are popular now. We did not win the election. We received 7. 8% of the vote. We felt like we made a big difference. Nowadays, it is almost a routine, that people every year go to holydays. Often they travel to the places abroad. These places are often very popular and well-known. Even though these places are popular, the countries still promote them and want more people to come. This is because tourism is very important for the economy but not in all cases for the citizens. If so, should countries encourage tourism? Firstly, tourism leads to the development of the country. The desire to attract tourists to a certain area often encourages governments to improve local facilities which is beneficial for both, citizens and tourists. On the other hand, the development of the country must be somehow controlled and planned in such a way, it does not destroy the natural beauty of the country. Over-development leads to ugly, crowded tourist spots and environmental damage. Consequently, the development if necessary but is has to be done thoroughfully. Secondly, tourism has some positive and negative effects on a country’s economy. Many people claim that tourism is an important source of income. This is illustrated by the fact that in the touristic countries are very few possibilities to find a job not connected with tourism. Nevertheless, country’s economy may become so dependent on tourism that it is weakened and when something unexpected happens, for example a natural disaster, that tourist do not arrive for a long time, the country is helpless because of lack of resources. Thirdly, tourism greatly influences the citizens’ culture. Tourism allows people to experience other cultures. They may see how foreigners behave, what clothes they wear or what are their customs. However, this impact of tourism may destroy the local way of life. For instance the customs of the local people may simply disappear and be displaced by those brought by the foreigners and the local uniqueness changes into cultural mixture. To conclude, there are arguments to both, that countries should and should not encourage tourism. On the one hand, we have economic advantages and possibilities to experience other cultures. On the other hand, tourism overused may lead to the economic weakness of a country and to permanent changes of the local culture.

Personal Values and Ethics Essay

Those people and things I value most is God, my recovery, self, respect, family, education, career, freedom, friends, community, and finance. For me, these people and things are desirable and important. However, there are times when those things and people cause dilemma in my life, and when I neglect to attend to them, especially when it is those values concerning family, friends, and community, I develop this personal conflict. One thing I have learned to value most is my personal relationship with my Higher Power whom I chose to call â€Å"God. While in active addiction I did all types of horrible things that I should have lost my life for. However, God kept me safe and healthy throughout my entire time in active addiction. For instance, there were times when I would be coming down off a multi-month drug binge and was hungry, but I was too week from the large amounts of drug intake to go find food. My Higher power always came through for me and provided me with the much needed nourishment for my body. Once my mind started to clear, I was could see how my Higher Power had been keeping and carrying me and learned to appreciate and value Him a great deal. Because of my past active addiction, other than drugs I have not always known what I valued. In fact, there was a time when I did not value myself, anything, or anyone. Since being in recovery I have learned to value me, other people, and things. I think that what shaped my values most is my being forced to honestly work a 12-step, self-help program and actively participate in the recovery fellowship of Narcotics Anonymous (N. A. ). In the rooms of N. A I was able to find me and my truths, and this provided me this strong desire to seek personal change and find a new productive way of living life. Acquiring this strong desire for lifestyle changes and seeking it in this fellowship, I was forced to involve myself with people who are free of drugs, living a N. A. Program way of life, and had significant clean time. It was these individuals who molded, helped, and shaped me to develop a sense of self. These new people in my life loved me until I learned to love myself, and this provided the opportunity for me to learn to value me and those people and things in my life at the time. As I continue to fight for my recovery, and as time go by, I noticed that over the years those people and things I value most changes on some level, and honestly working a program has provided me a much better quality of life. For this I have developed this great value for the program of Narcotics Anonymous and its members. Early in my recovery I lived with and in a lot of guilt. At that time, the only thing I had learned to somewhat value was I, and I had done and caused so much damage in my life. This led to my having to deal with a lot dilemma’s that lead to a lot of convictions, and as a result of these convictions, I began to value myself more. Because of this I was later able to appreciate me and not do anything else that could bring potential danger in my personal life and would make me feel worse than I was feeling. Since being in recovery with significant clean time, the level of how much I value people and things has changed. I think that by my incorporating the principles of the 12-steps in my personal life effects my approach and outlook to life. In honestly working these steps I am forced to look at both me and how I am interacting with society. As a result I find that I appreciate people and things more and have come to value them more. I value my family a great deal, especially my immediate family, e. g. , my mom, sister, brother, stepfather, guide mother, and guide sisters. They are always there for me no matter what or how bad I or it had gotten. I did not call often for help, but when I did my family was there to love and support me in any way they could. Today, they are right here on the side lines cheering me on, and they show their appreciation for my new way of life through each of their actions. As a result I have built some wonderful relationships with my family and, I have learned to value and appreciate those relationships a great deal. While facing one of my many horrible consequences I made the best decision, I could have ever made. This was the decision to go back to school to earn my GED. Because of my consistent good accomplishments in school it provided me this great since of appreciation for school and at some point I began to value education a great deal. Today I still value education and although I am facing many dilemmas in my life that, causing conflict with this value, I still push myself to accomplish my education goal. I think that going to prison is something that helped me establish a great value for my freedom. It was not a good feeling being locked up in a small cage like some animal. Neither did it feel good to have others tell me when to sleep, eat, bath, etc. While in prison I was forced to be alone with me and learn how to be in a relationship with me. As a result my sense of self multiplied, and it was the first time that I felt this sense of personal value. Although I had lost the ability to do so I have always valued work and establishing a career. This is one value that was instilled in me from my mother. I watch her work day in and day out to provide for and take care of us. Due to my being raised in a neighborhood where many of the children’s parents did not work I took great pride in and valued the fact that my mom had a job. Not just a job but a job that allowed here to give me and my sister most of the things we wanted. Watching my mom work instilled in me a desire to work as well. Once I started to work, how I valued working changed because I was now getting a check. Making money from work provided me this very strong value and desire for both work and money, and it also confirmed for me that working a job was the only way I could make money, thus being able to take care of me and make it in this world independently. Here recently I have come to value friends and community. I guess that this is due to my having established some healthy relationships that I appreciate and desire versus the those that I was accustomed to in my past and resented. Today, I am well liked and respected by personal friends and people in my community, and this provides me a sense of belonging and being apart. An ethical dilemma I had little difficult with was one that happened when I was working as a case manager at this Social Service Agency. There was a female client who came into the office seeking rental assistance services. During the assessments it was learned that she had participated in another rental assistance program through another agency six months prior. Due to the agency being in relationship with this agency, through Memorandum of Understanding, our office was able to call their office and provide and get information about this young lady participation in their program. After contacting the partnering agency it was learned that the client had participated in another rental assistance program four months prior to receiving services there. As a result it was believed that the client was abusing the rental assistance programs and funds in the area and was denied services. This did not cause much conflict with my personal values because this client was abusing the system. I know of many people who could really use, need, and deserve the assistance and here this lady is abusing it. I wanted to be angry with her and sabotage her file so she could not ever receive any kind of services from the agency again, but I knew this would be unethical practice and I did not do it. I felt that this client deserved to be denied for assistance; however, many of the staff including myself argued that contacting these external agencies about the case, and providing information about the client was in violation of the client’s confidentiality rights. I think that this lady and others like her needed to be stopped, and the rental assistance program funds needs to be protected from abusers like this client. I think that I would have a lot of ethical dilemmas if I worked with the Department of Corrections (DOC) population, especially if I am employed in their health care/treatment system. I tend to believe that many of the individuals in this population do not want treatment and would refuse it if they could. DOC forces many individuals in their population to participate in treatments that he or she do not really understand and really have no interest in understanding. In fact, it is almost unheard of for inmates within the Department of Corrections to receive an informed consent prior to receiving various treatments or services. In most cases the health care department calls the inmate over and tells him or her what is going to be done and walks away without any further information until it is time to provide the treatment or service. This causes a dilemma for me because I believe that everybody, including prison inmates, should be entitled to the same privileges and freedoms when receiving treatment in prison. He or she should be provided an informed consent and allowed the opportunity to volunteer for services or treatment. There are some things that I desire and feel are important to me, e. g. , God, my recovery, self, respect, family, education, career, etc. Due to convictions that result from the desires to and importance of these people and things, I must sometimes deal with personal conflicts. Over the years, I have learned to value my relationship with God. God is at the top of my value list because he has done so much in keeping me. Today, I value myself a great deal. When I do not attend to my personal needs I feel this great sense of conviction and I think this result from my involvement with the Narcotics Anonymous program. I value the N. A. program because it and its members has provided me a new way of life at a greater quality.
